Standard Terms & Conditions

These terms are issued by Promax Engineered Plastics Limited “Promax Plastics” and are effective from January 1st 2015. They cover the use of our website – promaxplastics.co.nz.  Use includes visits to our site, purchases on our site, participation in our database and promotions. These terms of use apply to you when you use our website. Please read these terms carefully - if you need to refer to them again they can be accessed from the link at the bottom of any page of our website.

Promax is a New Zealand owned business. We have two factories, one in Rangiora, Canterbury and in Kerikeri, Northland.  This website is owned and operated by Promax Engineered Plastics Ltd. If you wish to contact us please use:

1. Content

While we endeavour to supply accurate information on this site, errors and omissions may occur. Promax Plastics does not accept any liability, direct or indirect, for any loss or damage which may directly or indirectly result from any advice, opinion, information, representation or omission whether negligent or otherwise, contained on this site. You are solely responsible for the actions you take in reliance on the content on, or accessed, through this site.

Promax Plastics reserves the right to make changes to the content on this site at any time and without notice.

To the extent permitted by New Zealand law, Promax Plastics makes no warranties in relation to the merchantability, fitness for purpose, freedom from computer virus, accuracy or availability of this website or any other website.


2. Ordering goods and services from us

When you place an order with us, you are making an offer to buy goods or services. An order is placed on our website via adding a product to the shopping cart and proceeding through our checkout process. The checkout process includes giving us delivery and any other relevant details for your order.  The final step consists of a confirmation page with full details of your order, which you are able to print as a receipt of your order

We reserve the right to limit the number of an item customers can purchase in a single transaction.

We will send you an email to confirm that we have received and accepted your order, which indicates that your order has been accepted and you may not cancel it.

We will take payment from you when we accept your order at time of checkout on our site.


3. Refusing or cancelling orders

In the unlikely event that the goods or services ordered are no longer available we reserve the right to refuse or cancel an order.

We reserve the right to refuse or cancel any orders that we believe, solely by our own judgement, to have been placed fraudulently.

While we endeavour to ensure that the price and description of goods or services is accurate, if there is an error in the process of listing a product or service on our website or a technical error in the processing of your order we reserve the right to refuse or cancel the order.

Our right to cancel orders applies to orders that have been accepted.


4. Returns

To return, please contact us IMMEDIATELY. Goods returned without a return authority form will not be accepted. ALL returns for ANY reason must have a “Return Authority” form completed and approved by Promax in a month from the date of invoice.  A Restocking fee of 15% of invoice value or $100 (whichever is greater) applies for goods returned, unless for reasons attributed to our company.  If non-standard product is supplied, then a restocking fee of 40% shall apply.  A return will also incur a freight charge. Goods purchased more than 1 month is non-returnable.

Please note we must be notified of goods damaged in transit NO later than 2 days after the receipt of goods and all damaged packing must be retained for insurance purposes.  Concealed damage must be notified within 24 hours.


5. Conditions of sale

Interest may be charged and will accrue on all overdue amounts at a rate of 2.5% per month.
Ownership of goods does not pass to the buyer until payment has been made in full.  If payment is not made in full by the due date, Promax has the right to retake possession of the goods.
The liability of Promax for any loss, damage, or injury, arising directly, indirectly, specially, consequentially, or otherwise from any defect in the goods is limited to the replacement or repair of such goods.  Other action in favour of the buyer will be at the option of Promax.
No loss or damage will be covered under warranty unless an official company order is obtained prior to commencement of repairs.
All orders must be confirmed in writing.

We currently accept the following credit cards:

  • Visa
  • MasterCard
  • American Express


You can also pay using your Farmlands* account and through internet banking.


7. Pricing

All prices listed on www.promaxplastics.co.nz are in New Zealand dollars and are inclusive of GST.  Please note that we reserve the right to alter prices on our websites at any time for any reason. Online and in store (through our dealers) pricing may differ.


8. Website and Credit Card Security

Customer login and checkout process is all using encrypted using SSL  (Secure Socket Layer protocol, whereby sensitive information is encrypted to protect your privacy.) This site does not store credit card details and all payments via the site are handled by PaymentExpress which is a secure, PCI compliant, third party. You can help to protect your details from unauthorised access by logging out each time you finish using the site, particularly if you are doing so from a public or shared computer.

For security purposes certain transactions may require proof of identification.


9. Delivery and Delivery Charges

At this time, we only deliver to New Zealand addresses, large items will be delivered to freight company depots for pick up.  Big tanks (over 10000 litres) will be delivered by Promax Plastics on specialised trucks – we will contact you to arrange delivery.  We do not deliver to Post Office boxes. 

Please note that a signature is required for all deliveries. It does remain the responsibility of the recipient to inspect goods prior to signing for the delivery. If goods are lost or damaged in transit, please contact us within 5 business days at support@promaxplastics.co.nz. We will use this delivery information to make a claim against our freight company. We will offer you the choice of a replacement or a full refund, once we have received confirmation from our freight company that delivery was not successful. 

Freight charges per item are quoted at the time of purchase.  Please see the delivery details outlined below for each category of tank. 

 

Aboveground Tanks 450-5,000 litres, including Slimline Tanks:  

  • Delivery is via Promax, or its appointed carrier. Normally this will take place within current advised lead time from placement of your order.   
  • Truck access is required.    
  • A contact person and phone number must be provided to receive delivery. 

Delivery Cancellation Fee:   Customer requests for an alternative delivery date, rescheduling or re-routing of the carrier or inability to unload at site, may incur a return or storage fee.   

Delivery to DEALER or CARRIER DEPOT:

  • All our products in this range are FREIGHT FREE to Dealer or Carrier depot 

Delivery to SITE or CUSTOMER:

  • For deliveries to site/direct to customer a FREIGHT CHARGE AND/OR HIAB CHARGE IS TYPICALLY APPLICABLE which will be added at time of order  
  • For 1000L and Less tanks only a freight charge will apply 
  • For 2000 – 5000L tanks freight charges will apply, and a Hiab fee will be added to the order where receiving site does not have a forklift available to unload. Manpower, excavators etc are not suitable nor permitted by our carriers. 
  • Slimline Tanks to AUCKLAND METRO and CHRISTCHURCH METRO are Hiab free to site 
  • Slimline Tanks to rest of country freight charges will apply and a Hiab fee will be added to order where receiving site does not have a forklift available to unload. Manpower, excavators etc are not suitable nor permitted by our carriers. 

Please check with your Promax Customer Service rep to clarify details and/or if a freight cost to client is chargeable.  

 

Aboveground 10,000 litres, or greater: 

  • All Promax ENDURO and XPRESS tanks, 10,000 litre and larger, are delivered free to your property.   
  • Delivery is via Promax or one of its appointed contractors. Delivery normally will take place within current advised lead time from placement of your order.   
  • Truck and Trailer access is required.    
  • A contact person and phone number must be provided to receive delivery.  
  • We will endeavour to deliver your tank as close as practically possible to your desired drop off location, but if there is limited access, over hanging trees or power lines or for whatever reason our driver feels it is not safe to do so, your tank will be delivered to the closest safe area to your site / address. 

Delivery Cancellation Fee:   Customer requests for an alternative delivery date, rescheduling or re-routing of the carrier, will incur a fee of $800 per tank.   

  

Underground and Septic 0.75, 0.9, 1.0 and 1.2m Tanks:

  • Delivery is via Promax or one of its appointed contractors. Delivery normally will take within current advised lead time from placement of your order.   
  • Truck and Trailer access is required.    
  • A contact person and phone number must be provided to receive delivery.  

Delivery Cancellation Fee: Customer requests for an alternative delivery date, rescheduling or re-routing of the carrier, will incur a fee of $800 per tank. 

Delivery to DEALER or CARRIER DEPOT 

  • Freight-free to your dealer, or Carrier depot.
  • Hiab fee will apply if it is required for delivery (excluding Auckland and Christchurch metro areas) 

Delivery to SITE or CUSTOMER:

  • For deliveries to site/direct to customer a FREIGHT CHARGE AND/OR HIAB CHARGE IS TYPICALLY APPLICABLE which will be added at time of order
  • AUCKLAND METRO and CHRISTCHURCH METRO are Hiab FREE to site 

For the rest of New Zealand: 

  • For 1000L and Less tanks only a freight charge will apply 
  • For 2000L and larger tanks freight charges will apply, and a Hiab fee will be added to order where receiving site does not have a forklift available to unload. Manpower, excavators etc are not suitable nor permitted by our carriers. 

Please check with your Promax Customer Service rep to clarify details and/or if a freight cost to client is chargeable.  

 

Underground 1.9m Tanks:

  • All 1.9m Undergrounds are delivered free to your site 
  • Delivery is via Promax or one of its appointed contractors. Delivery normally will take within current advised lead time from placement of your order.   
  • Truck and Trailer access is required.    
  • A contact person and phone number must be provided to receive delivery.  

Delivery Cancellation Fee: Customer requests for an alternative delivery date, rescheduling or re-routing of the carrier, will incur a fee of $800 per tank. 

  

Notes and Exceptions:  

  • Please check with Promax (or your dealer) for the terms applying to some areas and outer Islands.
  • Note that freight surcharges may apply on certain products.
  • Truck and trailer road access is required.

10. Delivery Period

Delivery lead time for products may vary.  Deliveries for large items are made to the freight company depot for collection from there.  You will receive an email that confirms that your order has been dispatched.


11. Accessing our service

Other than connecting to Promax Plastics website by HTTP requests using a web browser, you may not gain access to Promax Plastics website servers. You agree not to disrupt, modify or interfere with our websites or services and their associated software, hardware and servers in any way. You also agree not to modify any content or service on the Promax Plastics website. Furthermore, you agree not to use our site in any inappropriate or unlawful way.


12. Disclaimer

Our website is intended to provide information for people shopping our products and accessing our services, including making purchases via our website and registering on our database to receive e-mails from us.

While we endeavour to supply accurate information on this site, errors and omissions may occur. Promax Plastics does not accept any liability, direct or indirect, for any loss or damage which may directly or indirectly result from any advice, opinion, information, representation or omission whether negligent or otherwise, contained on this site.
